Terms of Service

1. Services

Brandality Solutions Inc. ("Brandality") provides branding, web design and development, print, and AI automation services. Specific deliverables, timelines, and fees are defined in each client's proposal or service agreement, which takes precedence over these general terms.

2. Payment

Project work typically requires a deposit before work begins. Monthly services are billed in advance and can be cancelled with written notice before the next billing cycle unless a service agreement states otherwise.

3. Intellectual Property

Upon full payment, clients own the final deliverables created for them. Brandality retains the right to display completed work in its portfolio unless otherwise agreed in writing. Third-party assets (fonts, stock imagery, plugins) remain subject to their own licences.

4. AI Services

AI-generated content is reviewed for quality but provided "as is." Clients are responsible for final approval of AI-generated material before publication. Brandality is not liable for outcomes arising from client-approved content.

5. Revisions & Scope

Each package includes the revision rounds stated in its description. Work beyond the agreed scope is quoted separately before it begins.

6. SMS / Text Messaging Program

Program: Brandality Solutions SMS Notifications. When you opt in via a consent checkbox on one of our website forms, we send text messages related to your requests and projects — mockup delivery updates, project and order status updates, appointment and consultation reminders, and replies to your inquiries.

Message frequency varies, typically 1–4 messages per month.
Message and data rates may apply.
Reply STOP to any message to opt out at any time. Reply HELP for assistance, or contact us at info@brandalitysolutions.com.
Consent to receive text messages is not a condition of purchasing any service.
Carriers are not liable for any delayed or undelivered messages.

7. Limitation of Liability

To the maximum extent permitted by law, Brandality's total liability for any claim is limited to the fees paid for the service giving rise to the claim.

8. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
